Terms & Conditions for the power flush of your central heating system.
These terms and conditions along with you booking confirmation email constitute the entire
agreement between us here at Pro-tech Powerflushing and yourselves for the powerflush of
your central heating system. These terms and conditions were written to be as clear and self
explanatory as possible. If there is anything that you do not understand or would like some
clarification dont hesitate to get in touch. We're a friendly bunch!
1. Definitions.
I. In these terms and conditions.
Company- Pro-tech Powerflushing of 49 Parkfield Drive, Birmingham B369EH.
Contract- Means the provision of services and formed in accordance with clause 2, parts 1 &2
below.
Services- means the work/service agreed with yourselves and confirmed by email with myself.
Price- means the price quoted by Pro-tech Powerflushing to you the customer and confirmed by
email.
You- means the customer placing the order for the services identified and confirmed by me
through email.
2. Application Of Conditions.
2.1 These conditions apply to any booking/service placed with Pro-tech powerflushing.
2.2 The contract between you and Pro-tech Powerflushing is formed once the company has
accepted the service placed by yourselves. These conditions are incorporated into and shall
govern the contract excluding all other terms and conditions. Please note clause 4.1.
3. Charges.
3.1 There will be an additional charge for variations to or additions to the services which you
ask for, or which we find become necessary whilst carrying out the service, and which could not
have been identified during the original quote. In such a case we will explain to you the reasons
for the extra work and let you know in advance what the charges will be. No additional work will
be carried out without your permission.
3.2 You shall pay the agreed price for service and any additional charges on completion of
service on the day by method of payment shown on website.
3.3 All prices for services are inclusive of chemicals needed to complete the powerflush.
4. Supply Of The Services.
4.1 We will not commence work if you decide to cancel your booking within the 14 day cooling
off period. If you cancel after this 14 day cooling off period, we at Protech Powerflushing reserve
the right to charge a £60 cancellation fee. If the cancellation fee applies this should be paid
without delay, within 30 days, starting from date of email confirming your booking.
4.2 Cancellation of booking.
You may cancel within 14 working days of booking a power flushing service with us. You can do this by ringing us on 07939805355 or alternatively by email.
We will confirm your cancellation by email or in writing to yourselves.
4.3The company will carry out the power flushing service given on the date confirmed with
yourselves by email. The power flushing service to yourselves is usually completed in one day. In
exceptional circumstances beyond our control, such as inclement weather, accidents for
example we may have to arrange another mutually agreeable date for the service to be carried
out. You will of course be contacted at the earliest opportunity in the unlikely event that this
may happen.
4.4 The company will need access to your premises at all times to perform the services. You
must ensure that the working area is clear and free from all obstacles and hazards. Although we
take great care when carrying out service, it is necessary for us to wear suitable protective
footwear at all times for health and safety reasons, this footwear is cleaned at start of working
day. It is the customers responsibility to provide suitable protection for carpets if customer
feels this is required.The company shall not be liable for any delay in performing the service
where this is due to your failure to comply with this clause.
4.5 If you are a tenant you may need your landlords permission for the services to be carried
out. The company will assume that you have such permission and will not have any liability for
any loss or damage arising from a failure to obtain such permission.
4.6 Access to property. It is your responsibility to let us into the premises where powerflushing
is to take place on date and time confirmed on email. If we are not able to gain access to the
premises at the time of appointment because you are not available to provide access we will not
be able to carry out the service. If we are not able to gain access to carry out a power flush at
this time we reserve the right to charge you for our costs. If we fail on two consecutive
occasions to gain access we may cancel your contract and charge for the full amount due.
4.7 It is your responsibility to ensure before the company starts the service that there is an
adequate water, drainage, gas and electricity supply to your home, If these are not present the
company has the right to cancel the contract, without liability on its part, and to charge the
customer £60 towards its costs.
5. Our Liability.
5.1 We will perform the service with all reasonable care and skill, but you accept that the
service may require removing or dismantling existing fixtures and fittings. In the unlikely event
that removal of existing fixtures and fitting is required this may cause some very minor damage
requiring redecorating of the area.This is the customers responsibility.customer £60 towards its costs.
5.2 The company will not be responsible for any leaks in the central heating system following
the services unless this is due to our negligence. Should leaks occur during the service you may
need to take up carpets and floor covering, and we will assist to the best of our ability if
required. In such case it is your responsility to replace flooring when service is completed.
Following the service minor redecorating, cleaning and odour removal may be needed, this is
your responsibility.
5.3 The aim of powerflushing is to clean corrosion debris and limescale from heating systems as
thoroughly as possible. Heating system components are made from mostly Iron and steel, there
will always be corrosion debris on metal surfaces and subsequently in system circulation. In
addition the fresh water added to systems contains a varying amount of dissolved limescale, this
can leave deposits on systems components. Small amounts of corrosion debris may be present
in system after the powerflush as a consequence of ;
A. System components such as heat exchangers, diverter valves, thermistors, pumps, air
vents/separators, pressure vessels. PRV's, cold feed pipes, motorised valves, TRV's, filling loops
etc. Powerflushing may not remove all debris due to condition, design and positioning of these
components.
B. Pipes may have solid blockages or valves may be stuck preventing cleaning of a radiator or
pipe circuit.
C. Design faults leading to ongoing corrosion for example; system pumping over into feed and
expansion header tank. Pumps drawing in air and presence of metals and consequent
electrolytic corrosion. If design faults and components are identified as faulty/ needing
replacement, Pro-tech Powerflushing will inform customer at time of powerflushing thus giving
them the opportunity to have problem rectified. If customer is unwilling to have faulty
parts/systems replaced by Pro-tech Powerflushing, or the company cannot carry out this work,
the system will be cleaned as thouroughly as possible accepting the limitations of the system.
5.4 Noises from boiler and system, for example, heat exchangers, kettling and pipework are
often signs of corrosion debris and these are often resolved following a powerflushing service.
They can however persist following the service and are not an indication that service was
ineffectual and not thouroughly carried out
5.5 To avoid airlocks in the boiler, pump and heating systems pipework, it is recommended that
air vents need to be insitu and working effectively. Pro-tech Powerflushing can fit these at
customer request.
5.6 It is necessary to disconnect/connect equipment to customers heating system for the
powerflushing service. Pro-tech Powerflushing will not be liable for any damage caused due to
defect in customers pipework and heating system. Exceptions to this are damage that was
reasonable foreseeable before start of powerflush or damage caused by our negligence. Note
that sometimes pump may need replacing following powerflushing service. The pump preceding
power flushing service may have been working under strain and in a few cases may not work
following refitting.
5.7 All other warranties, conditions and other terms implied by statute or common law are to
the fullest extent permitted by law excluded from the contract. Your statutory rights as
customer are not affected.
5.8 Pro-tech Powerflushing is only liable for losses that were foreseeable, and not for indirect,
consequential or economic loss to you arising out of this contract.
5.9 Nothing in these terms and conditions excludes or limits companies liability for death or
personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any matter
which would be illegal for company to exclude/attempt to exclude liability for.
6. Guarantee.
6.1 Pro-tech Powerflushing aims to provide a professional, friendly service to thoroughly clean a
heating system as much as system limits allow. We cannot guarantee the functioning of
customers existing heating system and components and that these have been designed and
installed correctly. Non ideal systems would be for example single pipe systems, gravity flow
circuits, positioning of pumps allowing air locking and/or drawing air into system. Pipework or
air traps without air vents. Feed tank overflows without the needed clearance above the pump.
Microbore pipework with double entry valves.
Unless Pro-tech Powerflushing has stated that it cannot guarantee the powerflushing service in
writing to yourselves:
Guarantee for powerflush will be for period of twenty
four months from date of completion for microbore and
plastic pipes. Period of sixty months for 15mm pipes.
Pipe sizing are those connected to the radiators.
Pro-tech Powerflushing will repeat the powerflushing procedure if we consider that there remains an abnormal presence of of corrosion debris within this twenty four/sixty month
period. If the company is requested to reflush a system by customer during guarantee period, or
on advice by third parties, there will be charge of 100% charge of original quotation if it is found
that a powerflush was not required. Please note that the insertion of inhibitor is required to
maintain your heating system at all times for the period of our guarantee.
Guarantee exclusions.
6.2 All replaced new parts will be covered by manufacturer guarantee. In this case the
powerflushing guarantee will not apply.
6.2.1 To any existing equipment at your premises not supplied by us.
6.2.2 Whereby you , other equipment or devices cause failure in heating system.
6.2.3 Where failure is due to work carried out by other third party contractors.
6.2.4 Where the failure is caused by or as a result of the wiring or connecting pipes and through
no fault of Pro-tech Powerflushing.
6.2.5 Where you have not notified us within seven working days after defect was discovered.
7. General
7.1 The company will not be liable if it cannot fulfill the contract due to reasons outside its
control, such as fire, accidents, war, adverse weather, industrial disputes, strikes and lockouts
not directly involving us.
7.2 No third party other than you will be able to benefit from this contract.
7.3 Pro-tech Powerflushing add a Build-Cert inhibitor at the rate of 1 litre per 15kw.
7.4 These terms and conditions together with the quotation set out the agreement between us
at Pro-tech Powerflushing and you the customer.
7.5 You agree that we may process your personal data in accordance with the Data Protection
Act 1998 and may pass such data to the company.
